      I'd definitely recommend reading Ian Lind's post for Dec. 15, as Glen mentioned. Everyone's getting hot and bothered over the word "porn," but again, the only crime here, if any, is improper computer use.

      Should he get canned? Sure. Should there be other penalties given the financial impact of his activities (as Surfingfarmboy notes, basically using his paid time for non-work-related activities)? Perhaps. But jail? I disagree with those of you calling for this guy to be put behind bars.

      Think of other things you can legally do at home that you shouldn't do at work. Sleep. Watch reruns of "Married with Children." Listen to CDs with "Parental Advisory: Explicit Lyrics" labels. Will that get you canned? Yes. Put in jail? One hopes not.

        indeed, wise one...restitution and job termination seem to be the way to go...why should the public pay to feed and house this guy at $60K per year? aren't our prisons already overcrowded?

            How is this a white collar crime? Only by really stretching how you apply this statute (as pointed out by Ian Lind):
            A person commits the offense of unauthorized computer access in the second degree if the person knowingly accesses a computer, computer system, or computer network without authorization and thereby obtains information.
            Again, the focus on pornography is irrelevant here. It makes the case salacious and oh so fun to joke about, but porn is apparently absent from the filing, because porn isn't illegal.

            If you're saying this guy should get the slammer for doing anything not work related on his work computer, I'd wager most desks in downtown Honolulu - because of some errant visit to Starbulletin.com or that quick bid on eBay - will soon be empty.

              Now that Ryan's pointed me to this thread, I'll jump in briefly.

              Did Rapozo "steal" from the public by not doing his job? We don't know.
              We do know, though, that he wasn't charged with stealing from the public.

              That's the important thing in this case.
              It isn't what we think he did wrong. There's a long list of those things.
              It's what he's being charged with in criminal court.

              And those charges are very scary to anyone who doesn't really want employers to be able to use criminal statutes to enforce their workplace rules and restrictions.

              If he stole, prosecute him for stealing.
              Don't trump up a case using a statute obviously aimed at a totally different type of situation.

              And, again, I wonder where his union is in all this.

              Oh, do you suppose anyone else at HPD knew of or checked out those files from time to time? Nah, of course not....

                Do you think this case would've drawn the same public outrage and scrutiny had it occurred in the city's sewage and sanitation department? I don't think so. The poor shmuck with apparently too much free time on his hands unfortunately got his hands caught in the pornographic cookie jar while working for the saintly Honolulu Police Department and is now, out of public indignance, being held to the same higher than normal moral standards of its men in uniform.
