True, there is a difference between the EA and EIS. I'm sorry for blurring the two together. I'd like to think that tens of millions of dollars is an exaggeration for an EIS but given the way the State operates, perhaps not.
The State apparently did not give a LEGAL RULING, it gave an administrative ruling. Hence the court disagreeing with the State's waiver and ruling that the environmental studies must be done.
and you are also correct that I am unaware that environmental groups who are unconnected to the Superferry have applauded the Superferry for raising the bar in terms of what everyone else should be doing. I thought many of the concerns about the lack of EA/EIS were raised (and taken to court) by environmental groups concerned about the lack.
