    James Pflueger is in the news again. This time it is for being indicted on tax charges. He supposedly claimed personal expenses were business expenses, to the tune of $80,000. And also of understating his income in 2003,4,& 5.

    But the big kicker is:
    In a second conspiracy charge, James Pflueger and his accountant are accused of sending proceeds from a 2007 California land sale to a bank account in Switzerland. They sent $14 million to the account that year, the indictment said.
    The conspiracy charge carries a maximum sentence of five years in prison, while the false tax return counts carry a prison term of up to three years. James Pflueger also faces a charge of not reporting a foreign bank account, which carries a term of up to five years.
    Still unsettled are his problems from the 2006 Ka Loko Dam brake, which killed 7 people.

    James Pflueger, 84, is charged in the deaths of seven people when the Ka Loko Dam breached and sent 400 million gallons of water downstream on Kauai's North Shore. The case is on hold pending a ruling by the Intermediate Court of Appeals. Pflueger's attorneys appealed Kauai Circuit Judge Randal Valenciano's refusal in January to dismiss the manslaughter charges. Pflueger owned the land that includes the Ka Loko Dam and Reservoir. Pflueger's attorney, William McCorriston, said that if the appeal isn't successful, the earliest the trial could be held is in late 2011.
    What a way to spend your 80's, in legal trouble after legal trouble.

              Of course, we should presume all of the indicted innocent until proven guilty beyond a reasonable doubt, or by a guilty pley by plea bargain.

              This is a Grand Juy indictiment, and things do not look very good for the five people who are charged. If found guilty by verdict of a trial, or by admission by plea, I hope they get the book as far as punishment.

              If guilty, it is criminal which was fed by greed.

                BTW, the remaining people pleaded not guilty of Friday, 10/8/10. The trial is set for May of 2011. Again, if found guilty, I hope the courts have no mercy on all of them.

                  From today's SA:

                  Retired car dealer James Pflueger pleaded no contest this morning to a charge of reckless endangering related to the 2006 Ka Loko dam breach that sent hundreds of millions of gallons of water downstream and swept seven people to their deaths.

                  Based on the plea, Circuit Judge Randal Valenciano found Pflueger guilty of the charge.

                  In exchange for the plea, state prosecutors say they will be dropping seven manslaughter counts against the 87-year-old landowner.
                  The court could impose punishment of community service, a fine and imprisonment for up to one year. If he'd been found guilty of the original manslaughter charges, each charge could have been up to 20 years in prison.

                  Also:

                  Pflueger’s company, Pacific 808 Properties, also pleaded no contest to seven counts of manslaughter. The judge also found the company guilty based on its no contest plea. The company agreed to pay the maximum fine of $350,000 for the manslaughter charges.
                  That money goes to the state for damn inspections and safety programs.

                  As for his indictment on the tax charges:

                  Pflueger’s plea to reckless endangering follows his acquittal in March on federal tax fraud and related conspiracy charges. U. S. District Judge Leslie Kobayashi found at the end of the nonjury trial that prosecutors failed to prove that Pflueger willfully filed false income tax returns and that he conspired with others to file false returns.
                  If I ever get in big trouble, I sure hope I have a bottomless pocket to afford good attorneys. But the reality is that I don't have $$ millions .... so I'd better stay out of trouble. Justice is not always even-handed, as we all know.

                    No offense to pigs, but Jimmy is a real pig, and corrupt Kauai scum let him get away with murder and other illegal things. If you listened to Malia Zimmerman this morning on the radio or followed her awesome coverage of this travesty, you know prison is where many of these filthy players should have been long ago, but no.

                      Besides the questionable outcome of the recent court case, there is this info by Zimmerman in the Hawaii Reporter:

                      Pflueger, an 87-year-old retired auto dealer with assets of $71 million, was able to use his power, wealth, influence and political connections to delay his criminal trial for years through multiple appeals.
                      Pflueger is nearly three years overdue in paying a multimillion dollar cash settlement to the victims of the Ka Loko dam breach who sued him after losing loved ones and property. In addition, Pflueger has refused to repair the Ka Loko dam since it breached more than 7 years ago, despite numerous warnings and assessments from the state Department of Land and Natural Resources dam inspectors.

                        Don't forget the measley 9K Jimmy is said to have stormed in with to bribe the official off his ass, and it worked. The layers of rotten onion are nearly innumerable in this case.

                            I had a hard time swallowing that too, Ron. This guy Pflueger had his trial delayed numerous times, and then his sentencing delayed numerous times — in hopes he could delay it long enough to never see the inside of a prison cell. It didn’t work. So after less then 45 days, he is granted early release. You have to love our justice system. They are more concerned about avoiding lawsuits then punishing convicted felons.
